Terms & Conditions

These terms and conditions apply to all offers, agreements, subscriptions and services of MaSy Mundo Creativo.

MaSy Mundo Creativo provides, among other things, services in the areas of digital marketing, social media, content creation, online advertising, AI solutions, automation and online visibility.

These terms apply to both business clients (B2B) and consumers, unless expressly stated otherwise in these terms.

Where a mandatory statutory consumer rule deviates from these terms, that statutory rule prevails.

An agreement is concluded when the client accepts an offer or quote from MaSy Mundo Creativo, orders a service or package via the website, or otherwise expressly agrees to the assignment.

The client is responsible for providing correct and complete data needed to carry out the work.

The applicable price is clearly communicated to the client before the agreement is concluded.

For consumers, prices are displayed including applicable taxes where legally required.

For business clients, a price may be stated excluding VAT, provided this is clearly indicated.

The payment term and method are stated on the website, quote, order page or invoice.

In the event of late payment, MaSy Mundo Creativo may, where legally permitted and after any required notice of default, temporarily suspend the services and charge applicable interest and collection costs.

MaSy Mundo Creativo carries out agreed work to the best of its ability and with professional care.

Unless expressly agreed otherwise in writing, the services constitute a best-efforts obligation and not a guarantee of a specific commercial result.

Results of, among other things, SEO, advertising, social media, online reach, AI systems and conversions depend partly on external factors and therefore cannot be guaranteed.

For ongoing services and subscriptions, a notice period of 30 days applies, unless a different period has been expressly agreed when concluding the agreement.

Cancellation can be made in writing or by email to info@masymundo.com.

Work already carried out and amounts already due remain payable upon termination.

For consumers, the mandatory statutory rules regarding the duration, renewal and termination of agreements also apply.

An accepted assignment cannot be cancelled free of charge by a business client, unless MaSy Mundo Creativo expressly agrees in writing.

When MaSy Mundo Creativo agrees to the termination of a business assignment, work already carried out, costs incurred and other agreed amounts remain payable.

For consumers, this provision applies only insofar as permitted under applicable consumer law.

When a consumer concludes an agreement at a distance, for example via this website, a statutory right of withdrawal of 14 days may apply.

When the consumer wishes MaSy Mundo Creativo to start the execution of the service during this withdrawal period, the consumer must expressly give permission for this.

When the consumer subsequently exercises the right of withdrawal after execution has already begun at their request, the consumer may owe a proportionate amount for the part of the service already performed.

When a service has been fully performed within the withdrawal period after the consumer has expressly consented to immediate execution and acknowledged that the right of withdrawal is lost upon full execution, the right of withdrawal may lapse in accordance with applicable legislation.

This provision does not limit any mandatory statutory consumer rights.

The client must timely provide all information, materials, photos, texts, access details, approvals and other data reasonably necessary to carry out the assignment.

Delays caused by the client's failure to provide necessary information or cooperation in a timely manner may affect agreed schedules and delivery dates.

For certain services, MaSy Mundo Creativo uses external platforms and services, including for example Google, Meta, Instagram, Facebook, TikTok and other online service providers.

MaSy Mundo Creativo has no control over changes to algorithms, terms, rates, accounts, availability or technical functioning of such external platforms.

MaSy Mundo Creativo therefore cannot be held responsible for changes or disruptions at these external parties that are beyond its reasonable control.

Advertising budgets, subscriptions, licences, hosting, domain names, software costs and other third-party costs are not included in the price of MaSy Mundo Creativo, unless expressly agreed otherwise.

The client is informed in advance when such costs are part of an assignment.

MaSy Mundo Creativo may use artificial intelligence and automation software in the execution of its work.

AI systems can produce incorrect, incomplete or unexpected results. Where relevant, MaSy Mundo Creativo checks and processes AI output before it is used for the agreed services.

The client remains responsible for final approval of material when it is presented for approval.

Unless agreed otherwise in writing, existing methods, systems, templates, prompts, concepts, software components and other intellectual property of MaSy Mundo Creativo remain the property of MaSy Mundo Creativo.

After full payment, the client obtains the agreed right of use for materials specifically delivered for the client, insofar as these rights can be granted by MaSy Mundo Creativo.

Third-party rights, including rights to stock material, fonts, software and AI or platform services, remain subject to the licence terms of those third parties.

MaSy Mundo Creativo is not liable for indirect damages, loss of revenue, loss of profit or loss of data, insofar as such a limitation is permitted under applicable law.

Nothing in these terms limits liability where exclusion or limitation is not legally permitted.

For consumers, all mandatory statutory rights remain fully applicable.

MaSy Mundo Creativo will endeavour to handle complaints within a reasonable period and to reach a suitable solution together.

MaSy Mundo Creativo may amend these terms and conditions when necessary due to changes in services, business operations or applicable legislation.

For existing agreements, changes are applied insofar as this is contractually and legally permitted. Changes that materially affect the rights of consumers are not applied retroactively where not legally permitted.

Underlying analyses, strategies, recommendations, concepts, quotations, execution plans and execution methods of MaSy Mundo Creativo remain the intellectual property of MaSy Mundo Creativo unless otherwise agreed in writing.

Without prior written permission, this information may not be copied, shared, resold or provided to third parties for the purpose of having the proposed work carried out by those third parties.

A quotation only gives the client the right to have the offered work carried out by MaSy Mundo Creativo after acceptance and payment in accordance with the agreed terms.

A quotation for one-time work does not create a subscription unless expressly stated in the quotation.

A quotation is valid for the period stated in the quotation. After expiry, MaSy Mundo Creativo may reassess the price, schedule and availability.

Technical diagnosis and implementation details may be recorded after acceptance in an internal or shared execution plan and do not automatically form part of the publicly shared quotation before acceptance.

Spanish law applies to agreements with MaSy Mundo Creativo.

For consumers, this choice of law does not affect the mandatory protection they enjoy under applicable consumer legislation.

Any disputes are submitted to the competent court in accordance with applicable legal rules.
